We receive your Personal Information when you voluntarily provide it to us through features of our Website and Systems, such as information request forms and account registration forms. We also receive your Personal Information when you voluntarily provide it to us through visits to the community, such as when you fill out a prospective buyer registration card. We may also receive Personal Information (such as your social network ID) from third party social media websites and services if you choose to enable certain features, such as logging in with your social media account information.

If you purchase a home in the community, we may receive certain other Personal Identification Information and Personal Information about you in connection with the purchase, such as your social security number, driver’s license number or other government identification number, occupation, and employer.

Personal Information may be collected directly by us or by third party service providers that we contract with to act on our behalf.

Usage Data

We automatically collect certain other information and usage data (collectively, the “Usage Data”) when you use our Website and Systems. The Company and its service providers may have previously deidentified or aggregated your Personal Information in such a way that it does not personally identify you, in which case it shall not be treated as “Personal Information” under this “Notice of Your California Privacy Rights.”

California Consumer Privacy Act

“Right to Know.” Under the California Consumer Privacy Act (the “CCPA”), California residents have the right to request that the Company disclose what Personal Information it collects, uses, discloses and sells (referred to as a “Request to Know”). We will notify you if you request that we delete your Personal Information and we are unable to do so.

“Right to be free from discrimination.” You may exercise any of the above rights without fear of being discriminated against.

To submit a request under the CCPA, please contact us by any of the following methods: (a) by e-mail at info@2177Third.com, or (b) submit a written request at our community sales office located at 2177 Third Street, San Francisco, CA 94107. When you submit a request by e-mail or in writing, please use “California Privacy Request – CCPA” in the subject line so that we may properly route your request. With your request, please specify whether you are submitting a “Request to Know” and/or “Request to Delete,” as described above. If you are submitting a “Request to Know,” please describe the information pursuant to the CCPA that you are requesting. We will contact you for additional information if we are unable to determine the specific nature of your request.

Please allow forty (45) days for us to respond to your request. We will let you know if we need more time to respond to your request.

For any of the above-mentioned rights, you may designate an authorized agent to make a request on your behalf. In the request, you or your authorized agent must provide including information sufficient for us to confirm the identity of an authorized agent. We are required to verify that your agent has been properly authorized to request information on your behalf and this may take additional time to fulfill your request.

We will use the information you provide to make your CCPA rights requests to verify your identity, identify the personal information we may hold about you and act upon your request. Wherever feasible, we will try to verify your identity without requesting additional Personal Information. However, in order to verify your identity, it may be necessary for us to request additional information from you, in which we will contact you in the manner you specified. We strongly recommend that you submit the email and postal address that you used when you agreed to our services or signed up for a newsletter.  After you submit a CCPA rights requests as described above, you will be required to verify access to the email address you submitted.  You will receive an email with a follow-up link to complete your email verification process.  You are required to verify your email in order for us to proceed with your CCPA rights requests.  Please check your spam or junk folder in case you can’t see the verification email in your inbox.

 

Pursuant to the CCPA, our response will cover the 12-month period preceding our receipt of your request.

SB 27: “Shine The Light” Law

In addition, under California Law SB 27, California residents have a right to receive once per year, from businesses with whom they have an established business relationship, the types of Personal Information that the business shared with third parties for the third parties’ direct marking purposes during the immediately preceding calendar year, and the identities of the third parties with which the business shared information. California law requires us to indicate how our Website and Systems respond to “Do Not Track” settings that may be offered by your web browser. “Do Not Track” is a browser mechanism that enables individuals to signal their preference regarding the collection of personally identifiable information about an individual’s online activities over time and across third party websites or online services.
